Tribunal Claims

Very often it is not necessary for an employee to take a case to the Employment Tribunal for unfair dismissal, discrimination or whatever. We are often able to negotiate a satisfactory compromise on behalf of the employee avoiding the need to present a Tribunal claim and the resultant expense and uncertainty. However, under almost all circumstances, tribunal claims need to be presented within three months from the effective date of termination and an employee should not wait for too long before seeking legal advice if he believes it worth while to bring a claim. If we are acting for you in a Tribunal case we will give you an estimate of the costs likely to be incurred as well as giving you an opinion as to the likely prospects of success.

2007/2008 saw a total of 189,348 claims brought against employers in the tribunals. This was a 31.9% increase on the previous year.

It is not obligatory to use a solicitor in the employment tribunal and if the claim is likely to be of small value, then economically it may not make much sense. The tribunal claim form can be completed and submitted online. (This can be accessed here)
